These Privacy Principles explain what client information we collect, why we collect it, how we protect personal information, and how and why in certain cases we may share such information among Hilliard Lyons affiliates, and in limited instances, with non-affiliates.
Our Consumer Information Privacy Principles apply to client information collected or used when Hilliard Lyons companies offer financial services to you. This disclosure is made on behalf of the following HL Financial Services, LLC companies: J.J.B. Hilliard, W.L. Lyons, LLC and Hilliard Lyons Trust Company, LLC; collectively referred to as “Hilliard Lyons.”
How and Why We Collect Personal Information from You as a Client
Hilliard Lyons collects and maintains information about our clients so that we can evaluate their financial needs and provide a broad range of financial services to meet those needs. Most of the information we collect about you comes directly from you - from applications, agreements or forms that you complete in order to receive our services. You may also provide us information when communicating with us in writing, electronically or by phone. We collect information from and about you in order to identify you as our client, to establish and manage your accounts, to complete your transactions, to understand your needs through market research, to inform you of products and services we believe meet your needs, and to comply with legal and regulatory requirements.
To help the government fight the funding of terrorism and money laundering activities, federal law requires financial institutions to obtain, verify and record information that identifies each client who opens an account.
For instance, we may collect the following personal information about you:
- Information such as name, address, e-mail address, phone numbers, Social Security number, tax identification number, assets, income, occupation and date of birth which we receive on client account applications, agreements and other forms.
- Information about your transactions and holdings with us, our affiliates or others, such as account balances, positions and history.
To help further protect your personal information, Hilliard Lyons has launched an Encrypted Email messaging service. This service is used when sending sensitive information. While our systems are already secure, email encryption gives us the added functionality of hiding a message’s content from eavesdroppers by converting it into an unreadable format. Likewise, our clients may use this system to send sensitive information and documents to us.
When an encrypted email is sent to you from Hilliard Lyons, you will receive a notification email in your regular email inbox with a link to the encrypted email service. You will need to register as a user of the encrypted email service the first time only. Subsequent access to the encrypted email service will require that you sign on with the password you establish on your first use. Each time you receive an encrypted email from Hilliard Lyons, you will receive a notification in your regular email inbox.
Protecting Your Privacy
We respect the premium you place on keeping your finances a private matter and consider the protection of your personal information to be the key component in building customer trust and a sound business practice. That is why we do not sell information about our clients or former clients to anyone. We also do not disclose any nonpublic information about our clients or former clients to anyone, except as requested or authorized by our clients, as necessary to process a transaction or service an account, as requested by securities or other regulatory authorities, to others pursuant to subpoena, or as otherwise permitted or required by applicable law.
We may disclose information about you or your account to affiliates and nonaffiliated companies that perform administrative or marketing services on our behalf to help us service your account(s) such as printing and mailing companies, and with investment advisors or to other financial institutions with whom we are developing or offering investment products or services. When we enter into such a relationship, our contracts restrict the companies’ use of client information and require them to implement safeguards to maintain the confidentiality of such information.
We restrict access to your personal information to those employees who need to know that information to provide investment products or services to you. Employees who have access to your personal information are required to maintain and protect the confidentiality of that information and must follow established safeguarding of client information procedures. We also maintain physical, electronic and procedural safeguards to protect nonpublic client information.
At Hilliard Lyons, we strive to maintain the highest standards of confidentiality and to always respect the privacy of our clients. This annual disclosure of our Privacy Principles is provided in accordance with Title V of the Gramm-Leach-Bliley Act and its implementing provisions. We will also comply with state privacy laws to the extent they apply.
